Lord Lloyd of Berwick moved amendment 55D, in clause 52, page 44, line 19, at end to insert: “(4) Notwithstanding subsections (1) to (3), no transfer of a class of applications falling within subsection (5) may be made unless a draft of a statutory instrument specifying the class of applications to be transferred has been laid before and approved by resolution of each House of Parliament. (5) The applications are those which call into question any decision made under— (a) the Immigration Acts, (b) the British Nationality Act 1981 (c. 61), (c) any instrument having effect under an enactment within paragraph (a) or (b), or (d) any other provision of law for the time being in force which determines British citizenship, British overseas territories citizenship, the status of British National (Overseas) or British Overseas citizenship.”
