Lord McKenzie of Luton moved amendment 58D, in clause 94, page 63, line 22, at end to insert: “( ) Regulations under this section must provide for an exemption from the application of the benefit cap for vulnerable individuals, and individuals and couples with children, who: (a) as a result of the application of the benefit cap, the relevant local authority would consider threatened with homelessness and in priority need, (b) are owed a duty to be provided with interim or temporary accommodation under section 188, 190, 193 or 200 of the Housing Act 1996, or (c) which the local authority has accepted as homeless and in priority need.”
