(2) Sub-paragraph (1) above does not apply—(a) where the land has been designated by the appropriate countryside body as suitable for access at night with dogs; and any such designation may impose such conditions or limitations as appear to be appropriate; or (b) to dogs which are on the land for some necessary or useful purposes, such as search or rescue.
